By using this site you agree to be bound by our terms of service. Users are strongly encouraged to read all terms of service before using the site or participating in any services or programs.

Accuracy of Information
BRS High Performance Hockey is not responsible for the accuracy, completeness or timeliness of information on the site. Dates, times, and locations for training sessions are provided for informational purposes only and are subject to change due to factors such as cancellation, low participation, ice arena schedule changes, and changes in ice costs. Users should not use this information as their sole basis for making any purchase decision. User acknowledges that changes to the schedule or location of a camp do not entitle the user to a refund.

User acknowledges that advice and information on our blog posts may be inaccurate and use of such information is at the discretion of user. BRS High Performance Hockey is not liable for any damage or loss due to the use of any advice or information presented on this website.
Your use of any information, lesson plans, advice, recommendations, etc. by BRS High Performance Hockey during any unsupervised activity on your own time (such as public skate, stick-and-puck, take-a-shot) is your responsibility. BRS High performance Hockey is not liable for any loss or damage resulting from your use of our advice, training or lesson plans.

In any instance where a “maximum” or “limited” number of players per camp is advertised, this information is illustrative only. BRS High Performance Hockey may, in our sole subjective discretion, decide to increase or decrease this number without notice. As an example, a camp that is advertised as “Limit 12 Players” may end up having more or less players participate. User should consider these numbers as an illustration of likely camp participation only, and should not use this as the sole basis for a purchase decision.

Affiliate Linking Program
BRS High Performance Hockey participates in certain affiliate marketing programs which include posting links to third party websites on BRSHockey.com. By clicking such links, you are exiting our site and agree that this third-party site may use cookies to track your use of their site. If you make a purchase on this site, BRS High Performance Hockey may be entitled to a commission for this purchase.

Changes to Services or Pricing
Availability of services and pricing are subject to change at any time. Prices listed on the website are informational only and do not constitute a binding contract.

Comments and Submissions
If you submit any comments, ideas, plans, proposals, suggestions or any other material via online or physical (ie, postal mail) means, you agree without restriction that we may edit, copy, publish distribute or otherwise modify your comment. You are not entitled to any compensation for our use of such comments. User agrees not to submit any comments which contain unlawful, abusive or obscene material. User further agrees not to submit comments that will violate any right of any third party. BRS High Performance Hockey reserves the right to remove any comment from our site for any reason.

Concussion Protocol
Hockey is a fast-moving, contact sport and it is impossible to eliminate the risk of injury, including that of concussion. While BRS High Performance Hockey is not affiliated with USA Hockey, we do follow USA Hockey’s protocols for handling concussions. This includes immediately removing from play any athlete who appears to have sustained a concussion and requiring that this athlete provide written clearance from a qualified health-care professional before returning to play. While precautions are taken to minimize risk and promote safety, User understands and agrees that it is impossible to eliminate all risk of concussion and agrees to hold BRS High Performance Hockey and all of its officers, employees, assigns, volunteers, and stakeholders not liable for any concussion sustained during BRS High Performance Hockey activities.

BRS High Performance Hockey may, at our sole subjective discretion, refuse any advertised discount if we believe a User does not qualify or if we believe that a User is abusing the terms of the discount. For instance, User is eligible for a “sibling discount” only if both registrants reside at the same physical address. “Sibling discounts” cannot be extended to other family members or friends who do not reside at the same physical address as the primary registrant. Please see “Referral Discounts” section for more information.

By submitting information via registration forms, contact forms or subscription forms, User agrees that BRS High Performance Hockey may send User informational emails regarding dates, times, locations of BRS High Performance Hockey camps as well as marketing emails for BRS High Performance Hockey services.

Governing Law
These terms of service and any separate agreements through which BRS High Performance Hockey provides User with services shall be governed by and construed in accordance with the laws of the State of Colorado.

You agree to indemnify, defend and hold harmless BRS High Performance Hockey, LLC and our parent, subsidiaries, affiliates, partners, officers, directors, agents, contractors, licensors, service providers, subcontractors, suppliers, interns, assigns and employees, harmless from any claim or demand, including reasonable attorneys’ fees, made by any third-party due to or arising out of your breach of these Terms of Service or the documents they incorporate by reference, or your violation of any law or the rights of any third-party.

Make-Up Sessions
Certain programs/camps may have advertised “Make-Up Sessions” to accommodate users who are unable to attend sessions for any reason. User’s inability to attend a make-up session does NOT entitle that User to any other Make-Up Sessions. IE, Once make-up sessions are scheduled and completed, no additional sessions will be offered. The responsibility to attend a make-up session is entirely on the User who wishes to do so and BRS High Performance Hockey is NOT responsible for any additional accommodations for Users who are unable to attend.

Notice of Photography, Audio and Video Recordings
While participating in any BRS High Performance Hockey program, you may enter an area (e.g., ice surface or strength & conditioning training area) where photography, audio or video recording is taking place. By participating in any BRS High Performance Hockey program you consent to such photography, audio and video recording. By registering any minor for BRS High Performance Hockey programs, you acknowledge that you are the legal parent or guardian of such minor and consent to the photography, audio or video recording of such minor while participating in the program. You understand and acknowledge that such recording may be used for marketing purposes and that you are not entitled to any compensation for reproduction of your image, likeness or voice in any BRS High Performance Hockey marketing materials.

Personal Information
By registering for any BRS High Performance Hockey service, submitting comments, or subscribing to our email list, you agree that we may collect certain personal information such as name, name of participating minor athlete, email address, address of personal residence, phone number. We do not share your information or sell it to any third party. This information may be used for marketing purposes by BRS High Performance Hockey, including (but not limited to): email marketing, direct mail marketing, phone calls. By corresponding with any “@brshockey.com” email address, you consent to having your email address added to our subscriber list.

Referral Discounts
Any advertised referral discount will be credited to User’s NEXT purchase. E.G., if user A has signed up and paid for camp X and then receives a 5% referral discount for referring User B to also sign up for camp X, User A can only apply this referral discount to Camp Y or Camp Z. The discount will not be retroactively issued to Camp X (or any camp that user has already registered and paid for).

Release of Liability for Training Services
By registering for any training service program offered, User will agree to release and hold BRS High Performance Hockey, LLC (sometimes referred to as “Company,” “Club” or “We”) harmless from, and assume all responsibility for, all claims, demands, injuries, damages, actions or causes of action to persons or property, arising out of or connected with your (or your child’s/ward’s/dependent’s) use of property, facilities, premises, owned or leased by the Company or use of the Company’s services. The agreement and release is for the benefit of the Company, its employees, agents, independent contractors, other users of the Company and all persons on the Company’s premises. This agreement includes your release of these persons from responsibility for injury, damage, or death to yourself (or a minor dependent) because of those acts or omissions claimed to be related to the ordinary negligence of these persons. This agreement also includes your representations as to important matters which the Company will rely upon.

User represents: (a) that you understand that use of the Company premises, facilities, equipment, services and programs includes an inherent risk of injury to persons and property; (b) that you (or your dependent) are in good physical condition and have no disabilities, illnesses, or other conditions that could prevent you from exercising and using the Company’s equipment/facilities without injuring yourself or impairing your health; (c) that you understand that ice hockey is an inherently dangerous sport which includes the risks of injury, paralysis and death; (d) that BRS High Performance Hockey, LLC utilizes a variety of non-standard implements for ice-hockey training including (but not limited to): ropes, tires, PVC pipe, ABS pipe, broken ice hockey sticks, wooden boards, foam barriers, and that use of these implements while training may result in injury, paralysis or death; and (e) that you have consulted a physician concerning an exercise program that will not risk injury to yourself or impairment of your health (or that of your dependent). Such risk of injury includes, but is not limited to, injuries arising from or relating to use by you or others of training equipment/apparatuses/PVC pipe/ropes/tires, locker rooms, ice sheet and bench areas, hockey pucks, and other Company property/facilities or property/facilities leased or rented by the Company; injuries arising from or relating to participation by you or others in supervised or unsupervised activities or programs through the Company; injuries and medical disorders arising from or relating to use of the Company’s property, facilities or services including heart attacks, sudden cardiac arrests, strokes, heat stress, sprains, strains, broken bones, and torn muscles, tendons, and ligaments, among others; and accidental injuries occurring anywhere in the ice rink including parking lot, lobbies, hallways, stairways, exercise areas, locker rooms, restaurant, bathrooms, pro shop, ice sheet, players benches. Accidental injuries include those caused by you, those caused by other persons, and those of a “slip-and-fall” nature.

If you have any special exercise requirements or limitations, you agree to disclose them to the Company before using the Company’s services, property or facilities; and when seeking help in establishing an exercise program, you hereby agree that all exercise and use of the Company’s facilities, services, programs, and premises are undertaken by you at your sole risk. As used herein, the terms “include,” “including,” and words of similar import are descriptive only, and are not limiting in any manner. You also acknowledge and represent that you realize and appreciate that access to and use of the Company’s property/facilities or property/facilities that are leased by the Company during nonsupervised times increases and enhances certain risks to you. You realize that if you use the ice rink or company property during nonsupervised hours, any emergency response to you in the event of need for same may be impossible or delayed. You realize that a delay in the provision of first aid and/or emergency response may result in greater injury and disability to you and may cause or contribute to your death. Use of the ice rink or any BRS High Performance Hockey, LLC property/facilities with no one else present to supervise or watch your activities is not recommended and would not be allowed unless you agree to assume all risks of injury, whether known or unknown to you. You do hereby further declare yourself to be physically sound and suffering from no condition, impairment, disease, infirmity, or other illness that would prevent your participation or use of the facilities, equipment or ice sheet except as hereinafter stated. You do hereby acknowledge that you have been informed of the need for a physician’s approval for your participation in an exercise/fitness activity or in the use of Company property and facilities. You also acknowledge that it has been recommended that you have a yearly or more frequent physical examination and consultation with your physician as to physical activity, exercise, and use of exercise and training equipment so that you might have his recommendations concerning these fitness activities and equipment use. You acknowledge either that you have had a physical examination and have been given your physician’s permission to participate, or that you have decided to participate in activity and use of equipment and machinery without the approval of your physician and do hereby assume all responsibility for your participation and activities, and utilization of equipment and machinery in your activities.

If User is purchasing training services on behalf of a minor, User acknowledges and agrees to all of the foregoing information on behalf of such minor.

Terms of Payment
– Credit Card Transactions
Credit card transactions on BRSHockey.com are processed by third party service Stripe, Inc. BRS High Performance Hockey is not responsible for any loss or damages due to breaches of data or personal information collected by Stripe, Inc.

– Automatic Recurring Billing (ie, Payment Plans)
Users who sign up for automatic recurring billing (also known as payment plans) agree to the terms of such plans. Credit card information will be stored and the user will be charged at a regular interval until the balance due is paid in full. User will not attempt to avoid paying in full by cancelling a credit card or fraudulently disputing a charge. Users who do not provide billing information and opt to receive monthly invoices while on the payment plan agree to promptly pay all invoices. Any user who does not pay invoices on time is considered delinquent/not current/past-due. Any user who is delinquent/not current/past-due may not participate in any BRS High Performance Hockey programming until all invoices are paid in full in and the account is made current. Any user who makes a payment on the payment plan and then refuses to make future payments will be barred from BRS High Performance Hockey programming and no refunds will be given.

– Refunds
All sales are final. No refunds will be issued for any camp, lesson, clinic, strength & conditioning training session or other service provided by BRS High Performance Hockey. This “No Refund Policy” applies to all registered participants who are unable to attend any camp or training session for any reason, including illness, injury, natural disaster, family emergency, acts of god, weather, traffic, schedule conflicts, distance of training location, etc. In the event that a previously scheduled program is canceled by BRS High Performance Hockey, refunds will be issued to registered customers minus the 3% credit card processing fee that is charged by our provider. For example, a $300 registration will be entitled to a $291 refund in the event that BRS High Performance Hockey cancels this program.
